The Town of Yew vs. Nickola, Vice Mayor of Trinsic Court of Truth, 5-Feb-99

Thrawn: Greetings all

Thrawn: I believe we are ready to begin ahem we are here today to get to the bottom of a hideous crime one that left one man, Dain, dead and was an obvious attempt on the life of the Yew Mayor, Gargish Dragon Nickola has been charged with the crime, and her case will be presented today represnting her will be Orchid, the Mayor of Trinsic the prosecution will be led by Lori

Lori: *waves*

Thrawn: it is our hope to get to the bottom of this crime, and find out the Truth that said... let the Trial begin, with opening statements by the prosecution

Lori: Ahem Today - we will present facts which will show - that beyond a doubt The Vice-Mayor Nickola is indeed guilty of attempting to poison The mayor Gargish Dragon and in doing so took the life ofDain you will see that Nickola has motives to do such an unspeakable act She, Nickola is GUILTY!

Thrawn: thank you... and now opening statements from the defense

Orchid: In defense of our beloved Vice Mayor, Nickola Who has most wrongfully been accused of such a nefarious deed I will present the facts that will prove to every soul in this courtroom of her innocence. I hope to make every one, especially the Yew Council who is obviously under great emotional stress because of the assassination attempt see that she is everything BUT guilty! Thank you

Thrawn: thank you... now, the prosecution may call it's first witness

Thrawn: please take the stand to my left

Lori: Xena please have a seat Greetings Xena

Xena Dragon: Greetings

Lori: Were you at the banquet that fateful night?

Xena Dragon: I was at the Trinsic banquet at that day, yes

Lori: And Nickola was present at this banquet?

Xena Dragon: yes she was there

Lori: Do you recognize this Xena?

Xena Dragon: It looks like a bottle of liquor

Lori: ah! i enter into evidence item A a bottle that contained the tainted drink which was served to GArgish Who served Gargish the drink...do you remember?

Xena Dragon: *takes a sip of water* I remember that Nickola served us all drinks just before it all happened

Lori: before what happened Xena?

Xena Dragon: Before Dain started to feel bad and had to leave the banquet

Lori: ah! And why was Dain feeling ill?

Xena Dragon: That is hard to tell, but later we found poison on his tongue He did seem poisoned as he left the room though Wretching in pain...

Lori: did Dain not grab the drink intended for Gargish?

Xena Dragon: I think he might have done that, he was a bit drunk it seemed and grabbed a glass a glass that stood in front of Gargish

Lori: So...Dain (rest his soul) grabed Gargish's glass...drank it...and became ill...yes?

Xena Dragon: Yes, in that order

Lori: and later...when you checked in on Dain...what did you find?

Xena Dragon: I found his body on the floor of the Inn he looked extremely ill

Lori: did he say anything at that time?

Xena Dragon: He was not breathing anymore

Lori: and did you examine him at that time?

Xena Dragon: I feared for his life no, I immediately went to get help

Lori: i see after Dain had passed away did you examine him then?

Xena Dragon: yes, when I returned with more people it was obvious that Dain was dead and since I was the one who found him, I examined the body

Lori: what at that time seemed to be the cause of his death?

Xena Dragon: I firmly believe that Vermin Extermination poison killed Dain

Lori: ah Xena...can u describe to the court what this poison is?

Xena Dragon: I think I can

Lori: Proceed please

Xena Dragon: Vermin Extermination poison is used to get rid of rats

Lori: who would use this type of poison? in normal use

Xena Dragon: You could use it if you ran a warehouse or kitchen. Places where rats tend to show up

Lori: and is this type of poison fatal to humans?

Xena Dragon: In large doses, yes it is.

Lori: say...a large dose in a drink?

Xena Dragon: I almost lost my own father to that type of poison to kill a rat it only takes a few drops, so in a drink a large dose could be concealed

Lori: concealed in a drink yes?

Xena Dragon: yes

Lori: so.... after Nickola serves a drink to gargish

Thrawn: please wrap things up Lori...

Lori: it is grabed by a man named Dain he drinks it dies and death due to poison I'm done with questions thanks you Xena

Thrawn: thank you... the witness if yours, Orchid

Orchid: Thank you

Orchid: So Xena, my first question You examined Dain, correct?

Xena Dragon: Yes, I did.

Orchid: Do you have a knowledge of forensics studies?

Xena Dragon: I know a little about this.

Orchid: a little... And you compared the symptoms with that of your father

Xena Dragon: Indeed I did. There was a striking resemblance.

Orchid: Now, since Nickola is a Cook, and known to have used such a poison.. for the purpose of exterminating rats May I ask how she stands out as opposed to anyone else? Was it known, persey... if there might have been other guests at the banquet that may have had a similar type of background

Xena Dragon: I cannot answer that. I can only tell you what I experienced that day.

Orchid: ok.. Why did you assume the poison came from Nickola? disregarding the fact she served the drinks

Xena Dragon: I have a very strong memory from the time my own father was poisoned. The bottle that contained his poison came from a person with a name... ... that looked a lot like Nickola. I cannot remember exactly. It was long ago

Orchid: How long ago was it?

Xena Dragon: I was just a child

Orchid: May I ask your current age?

Xena Dragon: It is over 20 years ago

Nickola: jeez I'm not that old

Orchid: Over 20 years ago, you say?

Xena Dragon: aye

Orchid: So it is possible some of the details may be a little fuzzy

Xena Dragon: But I can remember that event as if it happened yesterday. I shalle never forget it

Orchid: in particular, the name on the bottle

Xena Dragon: Aye, I am not exactly sure about the name. niko... something.

Orchid: Ah.. Alright, thank you very much I'm Finished with the witness

Thrawn: very well, thank you Xena, you may step down I'd like to take a very brief recess to speak with the two lawyers

Thrawn: okay, it is now Orchid's turn to call a witness

Orchid: For my first witness I call Liam Karees to the stand Liam..

Thrawn: to push the process along a bit, I will be watching the time each witness is up

Orchid: Liam.. You have known Nickola for how long?

Liam Karees: Aye, for as long as I have belonged to the Council

Orchid: Approxamately how long is that?

Liam Karees: *ponders* Um, under a year

Orchid: but a decent amount of time nonetheless

Liam Karees: Aye, in the circumstances, yes

Orchid: During this time, have you ever known Nickola to hold a grudge, or hold anyone in Yew Council in Contempt particularly Gragish Dragon

Liam Karees: Well, to my knowledge, no She's never had anything but respect for Gargish, and his companions

Orchid: Have you ever known her to use such "Vermin Extermination Poison" as depicted by Xena Dragon?

Liam Karees: Well, I know she was very particular about keeping her kitchen clean ... As to what she did to keep it so, I know not

Orchid: Hmm but had she ever used such a poison on people?

Liam Karees: *laughs* Nay, she hasn't

Orchid: One final question You were there the night of the murder.. does Xena Dragon's story match up to the events you perceived?

Liam Karees: Well ... My own memories of the evening are admittedly a bit ... hazy

Orchid: hazy?

Liam Karees: Aye. I, as all the others had been partaking freely on the bountiful feast feast Drink's included But what I heard, it sounds about right

Orchid: hmm so for the most part you would agree

Liam Karees: um, sorry saw and heard Aye

Lori: you are a member of the Trinsic Council yes?

Liam Karees: Aye, I am

Lori: and Nickola is yur superior?

Liam Karees: Well ... recently she has been elected as the vice mayor, so yes

Lori: so... heaven forbid you would give testimony that would harm her.....

Liam Karees: Hmpf

Lori: Liam...were you drinking at the banquet?

Liam Karees: Aye, it was a celebration, after all

Lori: no more qustions

Lori: I call Gargish Dragpon, Mayor of yew *hehe* Greeting mayor...

Gargish Dragon: Greetings

Lori: I think i speak for all citizens when i say - I'm glad yur ALIVE to be here Gargish....

Gargish Dragon: Thank you Aye?

Lori: is the person who served yur drink present in this courtroom?

Gargish Dragon: Aye, she is

Lori: please name her for the court

Gargish Dragon: Her name is Nickola

Lori: and Dain did indeed grab yur drink?

Gargish Dragon: Aye... I was just about to grab the glass for the toast to the former mayor of Trinsic

Lori: and after Dain grabbed yur drink - he drank it?

Gargish Dragon: He seemed very drunk and obviously wanted more so he emptied the glass rather quickly

Lori: he then became ill.....and later died from the poison yes?

Gargish Dragon: I remember that he suddenly was feeling ill like if he had pain so he wanted to leave the room

Lori: *paces* so..Gargish - what would have happened if you had drank from that glass/

Gargish Dragon: and retire... I think I would have become ill instead of Dain and probably die *shivers from the thought*

Lori: that's all yur honor

Thrawn: thank you

Gargish Dragon: Hail Mayor Orchid

Orchid: Gargish, may I ask if Nickola has ever in the past shown any hostility towards you?

Gargish Dragon: No, she has not. I think I have been on good terms with the members of the Council of Trinsic

Orchid: I would agree with that hmm. May I see Exhibit A please?

Xena Dragon: In Lor

Gargish Dragon: Ah!

Orchid: Do you recognize this particular bottle?

Gargish Dragon: Aye, I do I remember Nickola serving me from the bottle I think..

Orchid: And you say the late Dain drank from this particular bottle?

Gargish Dragon: she was saying something like your glass is empty.. oh.. sorry.. I am distracting What was your question, please?

Orchid: you say Dain drank from this particular bottle, correct?

Gargish Dragon: Nay, he did drink from my glass

Orchid: May I point your attention to this bottle

Gargish Dragon: Aye..

Orchid: it appears to be unopened...

Gargish Dragon: does it?

Orchid: if not unopened, at least quite full

Gargish Dragon: I am sure the bottle looked like this

Orchid: were you poured a lot to drink?

Gargish Dragon: wouldnt it seem logical that it was still full since it was intended I was the only one to drink from that particular bottle?

Orchid: Can you tell me what type of drink you were pourred?

Gargish Dragon: For the toast, I was poured liquor

Orchid: liquor,,,

Thrawn: whether or not he can recognize one identical bottle from another hardly matters please wrap things up

Orchid: Well I have no further questions for this witness Thank you Mayor

Thrawn: thank you.. thank you Gargish, you may step down

Gargish Dragon: You are welcome

Thrawn: Orchid you may call your next witness

Orchid: I would like to call Fran-Horas to the stand please Greetings Fran

Fran-Horas: Greeting Orchid

Orchid: At the banquet it's true that before the toast, the drink supply ran out, correct?

Fran-Horas: I can't really tell becuz I wans't there! But

Orchid: I'm aware of that

Fran-Horas: I has in charge of the menu for the banquet, I supply the food and drinks!

Orchid: However, you had donated several cases of Ale for TCoH use right

Fran-Horas: Yes, sevral of Ale's case and others drinks!

Orchid: Now... Other drinks as well?

Fran-Horas: Yes

Orchid: none of your drinks were tainted to your knowledge?

Fran-Horas: None.

Orchid: it's not possible at all? Where did you get them from?

Fran-Horas: I buy from the best, Yew Winery!

Orchid: ahh.. Well I have nothing more to ask thank you

Thrawn: thank you, Lori, your witness

Lori: Fran-Horas.... were you at the banquet?

Fran-Horas: Yes No not at the banquet

Lori: so it's entirely possible that a bottle could have been poisoned while you were not there yes?

Fran-Horas: possibenly...yes!

Orchid: I call the defendant, Nickola to the stand You see exhibit A... is that the bottle of liquor you served to Gargish Dragon?

Nickola: Gargish did not drink liquor that drink his preference was ale and that is what I served

Orchid: Ale!

Gargish Dragon: No, I remember it being Liquor!

Orchid: so it is not possible that this liqour had the poison?

Nickola: not that bottle perhaps it was consumed by the recently deceased Dain but all I had on me was ale

Orchid: ok.. about the poison... when was the last time you made a "Vermin Extermination poison" or even better, used one

Nickola: when I still cooked by campfires, many years ago about 5

Orchid: 5 years ago?

Nickola: at least rats are attracted to cities, and I was limited in my travels to a city

Orchid: Now, you would never use such a poison on people? Have you ever in the past?

Nickola: no to both questions

Orchid: Have you ever been angry with, or held a grudge with Mayor Gargish Dragon?

Nickola: never

Orchid: So, in essense, you would have no motive to kill him?

Nickola: none

Orchid: Thank you I'm done questioning her

Thrawn: thank you, all your Lori

Lori: Nickola...

Nickola: aye?

Lori: you are a cook yes? a chef?

Nickola: yes, a Master Chef

Lori: and it's important for chef to keep thief cooking area clean yes?

Nickola: aye

Lori: and to do this...sometimes you would need to use Rat poison yes?

Nickola: not for a long time, but yes I did

Lori: yes or no please

Nickola: yes, I did

Lori: are you familiar with Vermin Extermination Poison?

Nickola: aye it is the kind I used to use

Lori: So you have used this type of poison.....no more questions

Thrawn: thank you... Nickola, you may step down Lori, please call your final witness

Lori: I call Jovar Jovar.... Did you investigate the crime?

Jovar: Aye, m'lady. I did with Lt. Vargen and Recruit Crim.

Lori: and you served a search warrant yes?

Jovar: Aye. Last night, we searched the premises of the TCoH workshop in Occlo

Lori: Who ordered the search warrant?

Jovar: Chief Justice Thrawn

Lori: And did you find anything of interest there?

Jovar: I believe so, m'lady. We found this letter hidden on the premises.

Lori: a letter?!? *examines letter*

Thrawn: hmm *looks over the letter* hmmm this seems quite interesting

Lori: what does the letter say?

Thrawn: I shall read it to the Court Nickola, How are you? I am doing very well as of late. I am planning to run for the position of Mayor of Yew in the coming election... I think I would have a good chance of winning....if Gargish were not running... Which brings me to the point of this.. I understand he will be in Trinsic soon.. Surely you could do something to help increase my odds of winning the election.. Enclosed you will find some coins to cover the expenses... Good luck to you... Lori: my goodness!

Jovar: *raises eyebrows*

Lori: that's all for Jovar

Gargish Dragon: Nickola! How could you even think about it!

Thrawn: thank you, any questions Orchid?

Orchid: hmm Let me read this letter for myself hmm

Thrawn: it's just as I read it

Orchid: Now you say you found this letter at the TCoH workshop?

Jovar: Aye. M'lady.

Orchid: Did you have a search Warrent?

Jovar: Aye, issued by the Chief Justice.

Orchid: And who was the warrent presented to at the shop?

Jovar: There was none there when we arrived, m'lady.

Orchid: so your forced your way in?

Jovar: I'm not sure I can answer that. When I arrived the door was open. Lt. Vargen was the first to arrive.

Orchid: ah

Jovar: We had to search most of Occlo to locate the workshop.

Orchid: This letter... you found it during your search?

Jovar: That we did, m'lady.

Orchid: so despite the warrent issue, we still have this letter... May I be allowed to call Nickola up for a few more questions?

Lori: Objection!

Thrawn: I dont see how that would be relevant

Orchid: Objection? the fact here is this

Lori: she has alrdy been questioned

Orchid: We have a letter here that Jovar and his men supposedly found

Jovar: not supposedly m'lady. we did find it there.

Orchid: after going into the TCoH Workshop without waving a warrent I need to question Nickola to see if she has ever seen this letter!

Thrawn: if there was nobody there, and door unlocked, it hardly seems an issue

Lori: Prosecution objects...letter was clearly hers

Thrawn: question the witness, Orchid

Orchid: Who else would be interested in the position of Mayor in Yew?

Jovar: Are you asking my opinion, m'lady?

Orchid: Or facts.. do you know anyone in particular?

Jovar: I can but conjejcture. But it would seem to me OES might be interested in

Orchid: OES?

Thrawn: speculation is irrelevant

Jovar: controlling the position. They took an active interest in the position of Chief Justice Beyond that, I suppose any number of people.

Thrawn: please stick to the facts

Orchid: Would you ever consider running?

Jovar: I am but a young man. I have no such desire at this time. But in a few years, I would be proud to serve my city.

Orchid: Do you happen to know if Vargen is interested in the Mayor position?

Thrawn: *sigh* such speculation is irrelevant to the facts

Gargish Dragon: what are you trying to accomplish?

Jovar: I don't know that. I know he intends to retire as Captain...

Orchid: The reason I ask

Jovar: should I not answer?

Orchid: Since I have never seen such a letter before, and since I, nor any other member of

Thrawn: Orchid, please wrap up your questions with relation to the facts

Orchid: TCoH recieved notification of a search warrent

Jovar: I can state as fact I have never heard Captain Vraal express such an interest.

Orchid: How do we know this letter is for real if we were not there to see it ourselves?

Thrawn: the letter has been presented as evidence by the militia

Orchid: Hah

Thrawn: it has been accepted as evidence, and will weigh in the decision now, if you have nothing further to say...

Orchid: surely you must be joking!

Orchid: Nevertheless, I'll wrap up in my closing statement when it comes time

Thrawn: thank you Jovar

Jovar: Thank you.

Thrawn: very well I will give each side a chance to briefly summarize

Thrawn: Lori? some final words?

Lori: of course It seems quite clear that Nickola - on orders from an annoymous person used her knowledge of Vermin Extermination Poisn to taint the drink of gargish Dragon with the intent of KILLING him. I'm done...i think

Orchid: First of all, I must say I am most displeased with the evidence presented. While I could not prove it to be false I hope it should be considered that it can also not be proven true I also might remind you all Nickola is my Vice-Mayor I trust her more than anyone, I'd have to say

Thrawn: your personal thoughts of her dont proove her innocence, Mayor

Orchid: Based upon my knowledge of her character she would never be inclined to fall to this deed Even though Jovar presents a motive the evidence seems weak, despite the fact Nickola was supposedly paid for it While I know it true she is not the richest one out there, she swears true to the virtue of Honor and would never be degraded to a vile murderer I have no more to say

Thrawn: thank you

Orchid: thank you

Thrawn: this Trial has now come to an end as the evidence has been presented. In light of the evidence which came to light during the trial and the testimony of the witnesses with the charges against Nickola being that of the murder of Dain and the attempted murder of Gargish Dragon the Court finds Nickola.... Guilty on both counts her sentence for these crimes shall be life within the confince of this prison

Thrawn: Jovar, if youwould lead the escort back to her cell...

Orchid: This is ridiculous! You must be insane!!

Thrawn: This Court is now adjourned
