The Republic Of Jhelom, in Order to form a governing Unity, establish Justice, insure domestic Tranquility, provide for the common defense, promote the general Welfare, and secure Liberty and our Posterity, do ordain and establish this Constitution.
Article I Legislature
Section 1: Legislative Power Vested
All legislative Powers herein granted shall be vested in a Republic Council, which shall consist of 13 Governors and 8 Mayors.
Section 2: Governor
1) The Governors shall be composed of Members chosen every sixth month by the citizens of Jhelom.
2) No Person shall be a Governor who shall not have attained to the Age of twenty five Years, and been registered a Citizen of the Republic Of Jhelom, and who shall not, when elected, hold position in any other governing body across Sosaria.
3) Governors will not subject any Jhelom citizen to their own justice system.
4) When vacancies happen concerning the Governors the Executive Authority, the Chief Magistrate, shall issue and open election. If such election hasn't any opposing authority or the Republic is at war the Chief Magistrate will fill such opening upon his choosing.
5) The Governors will make recommendations for a Mayor that will lead each separate region.
Section 3: Mayor
1) The Mayors shall be composed of Members chosen every ninth month by the citizens of Jhelom.
2) No Person shall be a Mayor who shall not have attained to the Age of twenty five Years, and been registered a Citizen of the Republic Of Jhelom, and who shall not, when elected, hold position in any other governing body across Sosaria.
3) Mayors will provide advise to the Governors regarding Law and Policy.
4) When vacancies happen concerning the Mayors the Executive Authority, the Chief Magistrate, shall issue and open election. If such election hasn't any opposing authority or the Republic is at war the Chief Magistrate will fill such opening upon his choosing.
5) The Mayors will conduct events and appoint citizens into position to assist prosperity.
Section 4: Elections of Governors and Mayors
1) The Southern Island of Jhelom, at the Jhelom Theater will hold all major events related to elections. Each running Member may, at any time or place, hold private speeches at any location in the Republic.
2) The election will take place on the 1st of either the sixth month for Governors or the ninth month for Mayors. This shall be thy day unless the governing body of Jhelom choose to vote with majority upon a different day or vote in majority to extend their appointed time frames.
Section 5: Rules of Governors and Mayors
1) Each may find ownership of business outside of the payments this Republic will provide for their appointed service. Such business must assist and expect nothing in return if used to expand the Republic; nor shall such Governor or Mayor use any republic Treasury fund to expand such business.
2) Each will fall under the Laws and Policies every Citizen must follow.
3) Each shall keep a Journal of its Proceedings, and from time to time publish the same to the Chief Magistrate upon request. Excepting the Yeas and Nays of past voting events.
4) Neither, without the Consent of the other, adjourn prior to the executive authority of the Vice Magistrate unless given permission or during urgent evacuation due to unexpected chain of events.
Section 6: Compensation and Privileges
1) The Governors and Mayors shall receive a Compensation for their Services, to be ascertained by Law, and paid out of the Treasury of the Republic. They shall in all Cases, except Treason, Felony and Breach of the Peace, and while pending any other illegal crimes be privileged to one whole amount for their entire Membership of 400,000 gold for Governors and 250,000 gold for Mayors.
2) No Governor or Mayor may hold multiple hats in the governing body unless war or appointed as such due to a critcal circumstance or urgent consideration by the executive authority of the Chief Magistrate.
Section 7: Laws, Articles, and Policies
1) All Laws, Articles, or Policies for raising Revenue or Tax shall originate only be the executive authority, Chief Magistrate of the Republic; but the Governors or Mayors may propose such idea.
2) Every Law, Article, or Policy which shall have passed the Governors and Mayors, shall, before it becomes final, be presented to the Chief Magistrate; If he approves he shall sign it, but if not he shall return it, with his Objections to the Council in which it shall have originated, who shall enter the Objections at large on their Journal, and proceed to reconsider. If after such Reconsideration two thirds of that Council shall agree, it shall be sent together with the Objections, to the Vice Magistrate, by which it shall likewise be reconsidered, and if approved, it shall become a Law, Article, or Policy.
Section 8: Legislative Power
1) The Council can, with majority vote, provide the Chief Magistrate parchments to..
- advise the need to lend or borrow money on the credit of the Republic.
- regulate Commerce with foreign Nations and allied or neutral organizations
- establish an uniform Rule of Citizenship and emissaries from foreign nations
- establish events
- promote the Progress of Science and useful Arts
- define and punish Piracies and Felonies committed on the high Seas
- declare War
- raise and support Armies
- provide and maintain a Navy;
- make Rules for the Government and Regulation of the Republic
- calling forth the Militia to suppress Insurrections and repel Invasions;
Section 9: Limits on Legislative Power
1) No money shall be drawn from the Treasury, but in Consequence of Appropriations made by Law; and a regular Statement and Account of the Receipts and Expenditures of all public Money shall be published from time to time.
2) No Title of Nobility shall be granted by the Republic: And no Person holding any Office in the Council , shall, without the Consent of the Chief Magistrate, accept any gift of noblity, Office, or Title, of any kind whatever, from any King, Prince, or foreign State.
Section 10: Limits on Jhelom Regional Territories
1) No Kingdom, City-State, or Organization shall enter Jhelom or any Treaty, Alliance, or Confederation; grant Letters of Marque and Reprisal; pass any Laws, Articles, or Policies that contradict or dictate the governing Republic on Jhelom soil. Upon such action will immediately require majority vote of the Jhelom Council to decide if declaration of war is required.
Article II Chief Magistrate and Vice Magistrate
Section 1: Election, Removal
1) The highest Powers shall be vested in a Chief Magistrate and Vice Magistrate. They shall hold his Office during the Term of one Year.
2) Anyone may nominate themselves or any other Elector. Such nominee once announced must be supported openly by a member of the Republic Council. This Elector must be of thirty five years of age and registered as a citizen of Jhelom. The process of debate, speech, or discussion will go on for one full month prior to the the last month of the previous Chief Magistrate's or Vice Magistrate's Term. If during this one month, prior to the current Chief Magistrate's or Vice Magistrate's Term, an Elector is not announced the current Chief Magistrate or Vice Magistrate will hold his Term for another full year.
3) In case of the removal of the Chief Magistrate or Vice Magistrate from Office, or of his Death, Resignation or Inability to discharge the Powers and Duties of the said Office, the Council will appoint, by force if need be, the proper elected Magistrate, or in absence of such, the representing Governor of Jhelom proper.
Section 2: Chief Magistrate Powers
1) The Chief Magistrate shall be charged of the Army and Navy of the Republic. He will have absolute powers to appoint Law provention Officer for everyday affairs and Military Officers empowered to carry out overall strategies on the battlefield. He shall have Power to grant Reprieves and Pardons for Offenses against the Republic, except in Cases of Impeachment.
2) He shall have Power with the Advice of the Council to make Treaties and he shall nominate, with the Advice of the Council, appointed diplomats, public Sages and all other Officers of the Republic, whose Appointment will be only required if written in such Treaty.
3) The Chief Magistrate shall have Power to fill up all Vacancies that must be filled due to concurrent events and have good judgement for such positions.
Section 3: Impeachment
1) The Chief Magistrate, Vice Magistrate, and the Republic Council of Jhelom, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors.
Article III Judiciary
Section 1: Judicial Power
The judicial Power of the Republic shall be vested in the Chief Magistrate as the Judge and the jury made up of at least five Council Members. The Vice Magistrate will act as a reviewer of passing evidence to ensure proper care to the entire Judical Sytem.
2) The trial of all Crimes, except in Cases of Impeachment, shall be by Jury; and such Trial shall be held in Jhelom Proper designated by the Judge.
Section 2: Treason
1) Treason against the Republic of Jhelom, shall consist only in levying War against them, or, in adhering to their Enemies, giving them Aid and Comfort. No Person shall be convicted of Treason unless on the Testimony of two Witnesses to the same overt Act, or on Confession in open Court.
2) The Chief Magistrate is the authority to declare the Punishment of Treason or any other major War crime. |
